In the latest round of Boulder vs. Xcel Energy, the city is charging that the utility's SmartGridCity didn't fulfill the promises it made so Xcel shouldn't be allowed to recoup the final $16.5 million it invested in the demonstration project that in its heyday attracted international attention.
Xcel argues otherwise, according to the Daily Camera, which reports the utility contends it has finished the demonstration project and should be able to raise rates to pay for it.
One of the key promises under dispute seems to be whether SmartGridCity gave Xcel customers the in-home monitoring capabilities that would enable them to control their energy usage. The Daily Camera has a good summary of the charges and counter-charges swirling around the topic.
An administrative law judge with the Colorado PUC is expected to hear arguments from both sides in early August before making a recommendation to the PUC, which makes the final decision on whether Xcel has met its obligations and can recoup the final chunk of its investment.
