Eric Breisach has represented cable television clients and trade associations in a wide variety of matters, including administrative hearings, regulatory rulemakings and other proceedings before the Federal Communications Commission, state public service commissions, the Small Business Administration and other regulatory bodies. He represents clients engaged in regulated businesses in the development of competitive strategies and resolution of disputes, whether on a transactional, strategic or special litigation counsel basis. Mr. Breisach also represents clients in strategic issues related to emerging technologies. Mr. Breisach counsels clients on privacy and data security matters, including developing strategies for maximizing the utility of consumer information while remaining fully compliant with legal restrictions. His experience also includes establishing policies and procedures with respect to data security, breach detection and notification, evaluating demands for customer information by third parties (both governmental and non-governmental), privacy audits and internal security procedures and external contracting, due diligence and compliance verification practices to avoid compromise of customer information by third party service providers. For clients with Internet components to their businesses, Mr. Breisach regularly provides counsel regarding legal requirements affecting website design (including pre and post-launch compliance reviews), operations, content, copyright compliance, disclosures and information collection practices ranging from general audience websites to those targeting children to those with online bill presentment and electronic payment. Mr. Breisach has been a regular speaker at state and national conferences on a variety of topics including cable television regulatory and competitive issues, online compliance issues for Internet service providers, and electronic communications/privacy issues for educational providers. He has written a number of articles on online/privacy issues for the Practicing Law Institute and the Michigan Council of School Attorneys. Mr. Breisach has served as an adjunct professor at the Thomas M. Cooley Law School, teaching courses in federal telecommunications law and broadcast and cable television law. Most recently, he served as a Visiting Professor, teaching equities and remedies. Mr. Breisach is a member of the American Bar Association and the American Institute of Certified Public Accountants. Mr. Breisach is admitted to practice in the District of Columbia and the state of Michigan.
